Klippfy Terms of Service
Last updated: October 12, 2026
By using Klippfy ("the Service") you agree to these Terms. If you do not agree, do not use the Service.
1. What Klippfy is
Klippfy is a tool that processes videos you upload to generate short vertical clips (using AI to pick moments, add captions, reframe the shot, etc.). You are responsible for the video you upload.
2. Minimum age to use the Service
You must be at least 18 years old to use Klippfy. When creating an account, you self-certify, at your own responsibility, that you meet this minimum age via a checkbox at signup. Klippfy does not perform any age verification beyond this self-certification; if we become aware that an account belongs to someone under the minimum age, we delete it along with its content.
3. Copyright in content you upload
- You represent and warrant that you own the rights (or have the express permission of the rights holder) to upload, process, distribute that content, including any voice, likeness, or face of a person appearing in it.
- Klippfy does not claim ownership over your video or the generated clips — they are yours.
- AI-generated or AI-assisted results — no guarantee of originality: some Klippfy features (Generate Video, Generate Image, AdMaker, Idea to Video, Narrator, generated music) use third-party artificial intelligence models (see the AI Policy). Klippfy does not guarantee that a result generated by these features is original or free of third-party rights — an AI model may produce, by chance or through similarity to its training data, a result resembling an existing work. You decide whether to publish or commercially use that result, and you are responsible for that decision.
- Indemnity: You agree to defend, indemnify, and hold harmless Klippfy, its operators, and its providers against any claim, demand, fine, or expense (including reasonable legal fees) arising from: (a) content you uploaded without holding the corresponding rights, (b) unauthorized use of a third party's voice, likeness, or identity in content you upload or generate, or (c) any breach of these Terms on your part. This obligation survives the cancellation of your account.
- Klippfy may retain technical metadata for a job (account identifier, timestamp, hashes) when necessary to investigate an infringement claim or cooperate with a competent authority, even after the associated video or clip has been deleted upon expiry of the retention period.
- If you are a copyright holder and believe a clip uploaded by another user infringes your rights, see our DMCA Policy.
4. Acceptable use
Using Klippfy to process, generate, or distribute the following is strictly prohibited:
- Explicit sexual content, or content that sexualizes, depicts, or endangers minors in any form (zero tolerance: the account is suspended immediately, without prior notice or refund, and reported to the relevant authorities and organizations, including NCMEC where applicable).
- Illegal content, hate speech, harassment, or content that incites violence.
- Deepfakes or impersonation of a real person: imitating or manipulating the voice, face, or likeness of a real person, without their explicit, verifiable, and prior consent, to pass them off as someone they are not or to attribute to them something they did not say or do. Klippfy does not offer voice cloning or the creation of a presenter from your photo or someone else's — the AI actors in the catalog are entirely synthetic. Trying to achieve an equivalent result by other means (for example, describing a real person in a prompt) is also prohibited.
- Impersonation of public figures, officials, or candidates for purposes of election disinformation or market manipulation.
- Malware, phishing, reverse engineering, automated scraping of the Service, or any attempt to exploit or overload the infrastructure.
- Any attempt to extract, discover, or independently use the credentials or API keys of the AI providers Klippfy uses internally (Google Gemini, OpenAI, fal.ai, or others) — those credentials belong to Klippfy, are never exposed to the user, and their unauthorized use outside the platform violates both these Terms and the corresponding provider's terms.
By uploading content to Klippfy, you represent and warrant that you hold the necessary rights and/or consents over that content (video, audio, image, text) for it to be processed — including its transmission to the third-party artificial intelligence providers described in the AI Policy (Google Gemini, OpenAI, fal.ai, Modal). Those providers contractually require that whoever submits data (in this case, Klippfy, acting on your behalf) holds the rights and permissions necessary over it — you are the one who gives us that warranty, which is why section 3 (Indemnity) makes you responsible for any claim arising from content you had no right to upload.
We reserve the right to suspend or cancel an account immediately and without refund for any violation of this section, to retain the associated technical evidence for as long as an investigation or legal requirement demands, and to report the case to authorities when appropriate.
5. AI-generated content — transparency
If you publish AI-generated content (images, video, or synthetic voice) that could be mistaken for real people, facts, or events, you are responsible for labeling it as AI-generated or manipulated when you publish it, to the extent required by the applicable regulation in your jurisdiction (for example, the EU AI Act, Art. 50, applicable from August 2, 2026). See the detail in the AI Policy, section 5.
6. Subscriptions, payments, and cancellation
- Payments are processed through Paddle. Klippfy does not store your card information.
- Your plan includes a monthly quota of processing minutes/credits (see your chosen plan). Unused credits are kept for as long as you maintain an active paid subscription (even if you change plans) and expire if you end up with no active paid subscription (for example, if you cancel and drop to the free plan, or let your subscription lapse without renewing). If you switch from one plan to another without ever ending up without an active subscription, unused credits from your previous plan are added to your new plan's credits.
- Your subscription renews automatically at the end of each billing cycle unless you cancel before that date. We notify you by email before each renewal.
- Refund policy: on your first purchase of a paid plan we refund 100% if you request it within 14 days and used no more than 20% of the included minutes and credits; we also refund a renewal requested within 7 days with no usage since, and always refund duplicate or incorrect charges. There are no prorated refunds for cancelling mid-cycle. The full details, and how to request a refund, are in the Refund Policy, which prevails over this summary.
- Exception — users in the European Union/United Kingdom: if you are a consumer (not a business) located in the EU or UK, the law grants you a 14-day right of withdrawal from the purchase. By subscribing to Klippfy and checking the acceptance box at checkout, you expressly request that the Service begin immediately and acknowledge that you lose the right of withdrawal as soon as the Service is performed (i.e., as soon as you upload your first video or the system starts processing your subscription), as permitted by Art. 16(m) of Directive 2011/83/EU and its UK equivalent. If you have not used the Service at all yet, contact us within those 14 days and we will refund you.
- You can cancel at any time from the Paddle customer portal, in the same number of steps you used to subscribe; access remains active until the end of the period already paid for.
- Prices are shown in US dollars (USD) and do not include applicable taxes (VAT or others). Paddle acts as the Merchant of Record for the sale: it calculates, collects, and remits the corresponding tax based on the buyer's country, and is the entity that appears on your card statement and invoice — Klippfy is not the seller of record for tax purposes of your purchase.
6.1 What a Klippfy credit is (and is not)
- A credit is an internal unit of consumption representing the right to use a given portion of the Service's processing capacity (minutes of video, or one AI generation depending on the feature — see the cost detail published in the product). It is not money, is not a financial instrument, has no resale or cash-redemption value, and earns no interest.
- Credits are strictly personal and non-transferable — they may not be sold, donated, lent, or transferred to another account, except for team mechanisms that Klippfy explicitly enables for organization plans.
- When they are consumed: a credit is deducted when the corresponding generation/processing starts, not when it finishes — but if that generation fails for a cause not attributable to you (an AI provider outage, timeout, internal error), the credit is automatically refunded to your balance (see the technical detail of this mechanism in our API documentation).
- Promotional or free-plan credits: may have their own expiry or restricted-use rules, indicated at the time they are granted; unless stated otherwise, they are consumed before the credits of a paid plan.
- When you cancel your subscription or close your account: unused credits are lost without compensation — see section 6 on when they expire, and section 7 (Privacy Policy) on what happens to your data when you delete the account.
- Chargebacks: if you ask your bank to reverse a payment after consuming credits generated by that payment, your account is suspended immediately (see section 6) and the credits corresponding to that transaction are voided, regardless of whether they have already been used.
7. Service availability
Klippfy depends on external providers (Google Gemini, OpenAI, Modal, Cloudflare R2). We make reasonable efforts to keep the Service available, but we do not guarantee 0% downtime. [TO COMPLETE: add a link to a status page (Better Stack / Statuspage.io) once one exists, or remove this reference until then.]
Force majeure: Klippfy is not liable for interruptions or failures of the Service caused by events outside its reasonable control, including but not limited to infrastructure provider failures (Cloudflare, Modal, Google, OpenAI, Paddle), natural disasters, internet connectivity outages, government actions, or labor disputes. In such cases, we will make reasonable efforts to restore the Service as soon as possible.
8. Sanctions and restricted countries
You may not access or use the Service if you are located in, or a resident of, a country or territory subject to comprehensive economic sanctions by the United States, the European Union, or the United Nations, nor if you are included on a restricted-persons or restricted-entities list maintained by those bodies (for example, OFAC's SDN list). This includes restrictions that our infrastructure and AI providers (Google, OpenAI, Cloudflare, Modal, Paddle, Amazon) apply to their own use, which we inherit as part of the Service's delivery chain.
9. Limits of liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including (to the extent permitted by law) warranties of merchantability, fitness for a particular purpose, or non-infringement. Klippfy does not control, review, or validate content that users upload before processing it.
To the maximum extent permitted by law:
- Klippfy is not liable for indirect, incidental, special, punitive, or consequential damages (including loss of revenue, data, or business opportunities) arising from the use or inability to use the Service.
- Klippfy's total liability to you for any claim related to the Service does not exceed the greater of (a) the amount you paid in the 3 months prior to the event giving rise to the claim, or (b) USD 100.
- Klippfy is not liable for loss of content that was not downloaded before the retention period elapsed (see Privacy Policy, section 4), nor for what a third party does with content that you yourself published or shared outside the Service.
- Every dispute is resolved individually; to the extent permitted by law, you waive the right to bring or participate in a class or collective action against Klippfy. [TO COMPLETE — legal review: define a concrete alternative mechanism (arbitration before which institution and rules, or exclusively the courts under section 11) so this waiver has a clear forum and is harder to invalidate, especially against consumers in the EU.]
10. General provisions
- Entire agreement: these Terms, together with the Privacy Policy and the other referenced policies (DMCA, Cookies, AI, Affiliates, API, Security), constitute the entire agreement between you and Klippfy regarding the Service, and supersede any prior agreement or understanding on the same subject.
- Assignment: Klippfy may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, restructuring, or sale of assets, without needing your prior consent. You may not assign your rights or obligations under these Terms without Klippfy's prior authorization.
- No waiver: Klippfy's failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right.
- Severability: if a clause of these Terms is found invalid or unenforceable by a competent court, the rest of the Terms remain in effect, and that clause is interpreted to reflect the parties' original intent as closely as possible.
- Notices: formal notices between the parties are given by email (to the contact address provided by each party), and are deemed received on the following business day after they are sent.
- Language: these Terms were originally drafted in Spanish. If available in other languages, the Spanish version prevails in the event of any discrepancy or conflict of interpretation.
11. Governing law
Klippfy provides the Service to users in any country, but is incorporated and operates from Mexico. These Terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Mexico, waiving any other jurisdiction that might otherwise apply to them based on their present or future domicile. This does not remove any consumer-protection rights that the law of your country grants you on a mandatory basis (for example, the EU right of withdrawal described in section 6). [TO COMPLETE — legal review: in consumer disputes with EU users, this Mexican-courts submission clause may not be enforceable if the consumer has the right, under their own law, to litigate in their country of residence. A lawyer experienced in cross-border consumer matters should review the real scope of this clause.]

Klippfy Privacy Policy
Last updated: September 24, 2026
This Privacy Policy explains what data Klippfy ("we") collects, what we use it for, who we share it with, and what rights you have over it. It applies to anyone who uses klippfy.com or our API ("the Service").
1. What data we collect
| Data | When | Why |
|---|---|---|
| When you pay (Paddle) or provide it on the free plan | Identify your account, send your API key, billing notices | |
| The video you upload | When you use /api/subir | It's the input to the service: generating the clips |
| Video transcript and text | Generated automatically during processing | Choosing the best moments, generating captions |
| Prompts, scripts, and reference files | When you use the AI generation tools | Producing the result you requested |
| Personal presenter photo (accounts predating this update only) | Stored historically, before we discontinued creating presenters from a photo | None active — kept only so you can view or delete it from your library; no longer used to generate new content |
| IP address | On every request | Rate limiting (preventing abuse) and security |
| Payment data | When you subscribe | Processed directly by Paddle — Klippfy never sees or stores your card number |
We do not knowingly collect data from minors beyond the minimum-age self-certification described in section 2 of the Terms and Conditions. If we detect an account belonging to a minor below that age, we delete it along with its content.
2. How we use your data
- Processing your video and generating the clips you requested.
- Automatically choosing the best moments using third-party language models (see section 3).
- Billing your subscription and sending you confirmations/invoices.
- Preventing platform abuse (rate limiting by IP/API key).
- Automatically reviewing AI-generated results before delivering them to you, to detect prohibited content (see section 3).
- Customer support, when you write to us.
We do not use your videos or transcripts to train Klippfy's own models, and we do not use them to train our providers' models beyond what their own API policies describe (see section 3).
You never communicate directly with Google Gemini, OpenAI, fal.ai, or any other AI provider — everything goes through Klippfy's server first, which applies your usage limit, your credit quota, and our own content rules before forwarding the request. Those providers' credentials (API keys) live only on our server and are never exposed to the browser, the app, or any Klippfy API response.
3. Who we share data with (third-party providers) and international transfers
- Google Gemini — primary engine for: (a) choosing the best moments of your video from the transcript and (b) interpreting free-text briefs in AdMaker/Idea to Video. Receives text (transcript/prompt), not the video file. [TO COMPLETE: processing region of the Gemini API under Google's terms]
- OpenAI — automatic backup for Gemini on the same text-analysis tasks, if Gemini is unavailable, and the Narrator's OpenAI voices (receives the script text). Receives text, not the video file. Processes data in the United States.
- fal.ai — third-party AI generation infrastructure used by the Generate Video, Generate Image, AdMaker, Idea to Video, and Show My Product tools. Depending on the tool, it may receive your text prompt and/or a reference photo (for example, your product photo in Show My Product) — never your Klippfy API key or the provider's credentials, which remain on our server. Choosing a predefined AI actor as a presenter does not send any real photo or audio to fal.ai, only an identifier for the chosen character. fal.ai acts as a platform that in turn runs third-party models (for example, the video and image generation ones); those models may have their own conditions and restrictions, in addition to fal.ai's, which Klippfy reviews before enabling each feature. Processes data in the United States (per fal.ai's public documentation at the time of this publication).
- Modal — infrastructure where the audio is transcribed (Whisper, on Klippfy's own GPU: it receives your video's audio), the final video is rendered (cropping, burned-in captions, face tracking) and where music/voice generation models run when applicable. Processes data in the United States.
- fal.ai (Kokoro / Inworld / MiniMax voices) — only if you choose one of these catalog voices for the narrator feature; they receive the script text (not your video or your audio). Coqui voices (free catalog) are generated on our own infrastructure and are not sent to any third party. Klippfy does not offer voice cloning at any level of the catalog. [TO COMPLETE: confirm each fal.ai voice provider's retention for this use before publishing]
- Hive Moderation — content-moderation service that automatically analyzes AI-generated images and videos, before they are delivered to you, to detect prohibited content. Receives the URL of the generated result, not your original files. [TO COMPLETE: confirm Hive's processing region and retention policy before enabling in production]
- Cloudflare R2 — storage of the original video and generated clips, for the duration of your job. Storage region: United States.
- Google — if you sign in with Google Sign-In, Google confirms your identity to us and shares your email and Google account name with us to create/identify your Klippfy account. We do not access any other data from your Google account beyond that.
- Resend — sending transactional emails. Processes data in the United States.
- Paddle — processes your payment and invoicing; we never see your card.
Since all of these providers process data in the United States, when you use the Service from the European Union/EEA, the United Kingdom, or another jurisdiction with international data-transfer rules, that transfer is covered by [TO COMPLETE — legal review: the actual transfer mechanism, e.g. Standard Contractual Clauses (SCCs) with the European Commission signed with each provider, or the EU-US Data Privacy Framework if the provider is certified under it]. You may request a copy of the applicable safeguards by writing to [email protected].
We do not sell your data to anyone, nor do we share it with third parties for advertising.
4. How long we keep your data
- Original video and generated clips: automatically deleted from Cloudflare R2 7 days after processing.
- Transcript: same retention as its associated video.
- Account data (email, plan): for as long as your account is active. If you cancel and request deletion (section 7), we delete it within 30 days unless the law requires us to keep billing records for longer.
5. Security
We use encrypted connections (HTTPS) throughout the Service, rate limiting to prevent abuse, and API keys are stored hashed, never in plain text — not even we can see your key after it has been issued. See also our Security page, including what we do in the event of an incident affecting your data.
6. Klippfy's role regarding your data
For normal use of the Service (uploading your own video, generating your own clips), Klippfy acts as the data controller of your personal data. If in the future we offer enterprise plans where a business customer uploads content belonging to its own users or employees through Klippfy, Klippfy would act as a data processor with respect to that data, and that business as the controller — in that case, a specific Data Processing Agreement (DPA) would be put in place. [TO COMPLETE if you sell B2B: add the DPA as a separate document.]
7. Your rights (LFPDPPP / GDPR / CCPA)
If you are in Mexico, you have the ARCO rights (Access, Rectification, Cancellation, Objection) under Mexican personal-data-protection law. [TO COMPLETE — local legal review: confirm the current regulatory reference, since the Mexican data-protection framework has changed recently and it's worth verifying that "LFPDPPP" is still the correct citation at the time of publishing.] If you are in the EU, UK, California, or another jurisdiction with data-protection laws, you have equivalent rights under GDPR/CCPA. In any case, you have the right to:
- Access the data we hold about you.
- Correct inaccurate data.
- Delete your account and all your files.
- Port your data to another service.
- Object to the processing of your data.
To exercise any of these rights, write to us at [email protected], or use the self-service available in your account: GET /api/privacidad/exportar-datos to download a copy of your data, and POST /api/privacidad/solicitar-eliminacion to request deletion of your account (with a 14-day grace period in case you change your mind, see POST /api/privacidad/cancelar-eliminacion). For cases that need human intervention (for example, questions about exactly what data was processed), keep writing by email. We confirm your identity and respond within 30 days. [Optional: if you process data at scale, consider appointing a Data Protection Officer (DPO) and publishing their contact info here.]
Your privacy choices (California / CCPA): Klippfy does not sell your personal data or share it with advertising networks. The only cookies that are not strictly necessary (analytics) are off by default and are only activated if you explicitly accept them in the consent banner (see the Cookie Policy) — that banner, together with your browser's options for blocking cookies, is your "Do Not Sell or Share My Personal Information" / "Your Privacy Choices" mechanism under the CCPA/CPRA.
8. Cookies
We use essential cookies (session/login) and, optionally, analytics and ad-measurement cookies only if you accept them in the consent banner you see when entering the site. See the full detail in our Cookie Policy.
9. Accessibility
[Optional, relevant if you sell to government or businesses in the US/EU: add an accessibility commitment consistent with WCAG 2.1 level AA guidelines, and provide a contact channel to report accessibility barriers.]
10. Changes to this policy
If we make significant changes, we will notify you by email or with a visible notice on the Service before they take effect.
